High Court Fines Builder For Harassment

The Delhi High Court has imposed a fine of Rs 1.5 lakh on a builder who harassed members of a housing society in Dwarka, using time-barred litigations for “recovery” of dues, which had already been paid to him.

“Such an attempt…is malafide, misconceived and most unfortunate…This petition demonstrates the heights of greed of a builder for claiming amounts for alleged disputes which are ex-facie no longer live claims,” Justice Valmiki J Mehta observed.

The High Court also imposed a fine of Rs 1.5 lakh on Mitra Guha Builders Pvt Ltd. Out of that amount, the society is to receive Rs 1 lakh as compensation. The construction of flats for Delhi EPDP Cooperative Group Housing Society in Dwarka’s sector-4 had been completed by the builder on September 4, 2001. Lawyer Namita Roy, appearing for the housing society, contended that the builder had been paid the due amount Rs 25, 93,105 in three installments in Oct, Nov and Dec 2001.
